1. This is an application for appointment of an Arbitrator. The parties submit before the court that the disputes arose out of a registered deed of lease dated March 31, 2021 and an amenities agreement dated April 1, 2021.
2. Both the parties submit that the agreements are co-extensive, co- terminus and co-existence. Parties also submit that the dispute resolution clause provides for settlement of the disputes by arbitration.
3. The notice invoking arbitration was issued by the petitioner on January 4, 2023.
4. Under such circumstances, the dispute is referred to arbitration of Mr. Swarnendu Ghosh, learned senior Advocate, Bar Library Club, who will act as the Arbitrator and settle the disputes between the parties. This appointment is subject to compliance of section 12 of

the Arbitration and Conciliation Act, 1996. The learned Arbitrator shall be at liberty to fix his remuneration as per the Schedule of the Arbitration and Conciliation Act, 1996.
5. This application is disposed of accordingly.
