Heard Ms. T. Radha Rani, learned Counsel appearing on behalf of Sri T.D. Phani Kumar, learned Counsel for the Writ Petitioners, Sri Bhagat Singh, learned Assistant Government Pleader for Registration & Stamps and Sri Shaik Khaja Basha, learned Standing Counsel for Waqf Board (Respondent Nos.2 & 6). 2.
The present Writ Petition is filed seeking following relief:
“Hence, the petitioner prayed that this Hon’ble may be pleased to issue an appropriate Writ Order or Direction, more particularly one in the nature of Writ Of Mandamus declare the action of the respondents in not considering the application of the petitioner vide TTA012300115898 dated 09-12-2023 to denotify the lands to an extent of Ac.0.76 Cents in Sy.No.344-1 in Kukkala Gunta, Dhamaramadugu Village & Post, Buchireddypalem Mandal, SPSR Nellore District from the Prohibited Properties List prepared under Section 22A (1)(c) of the Registration Act is illegal, arbitrary and violative of Article 14, 21 and 300-A of the Constitution of India and consequently direct the respondents to delete the property of the petitioners to an extent of Ac.0.76 Cents in Sy.No.344-1 in Kukkala Gunta, Dhamaramadugu Village & Post, Buchireddypalem Mandal, SPSR Nellore District, from the prohibited properties list i.e. Sec-22A (1) (C) of the Registration Act, and to pass such other order or orders as this Hon’ble Court may deem fit and proper in the circumstances of the case.”

Learned Counsel for the Writ Petitioners has drawn the attention of this Court to the Online Application seeking for deletion of the subject property from the list of Prohibited Properties under Category 22A-(1)(C) dated 09.12.2023 (Ex.P.10). Reacting to the Online Application made by the Writ

Petitioners (Ex.P.10), Sri Shaik Khaja Basha, learned Standing Counsel for Waqf Board (Respondent Nos.2 & 6), would submit that if some time is granted, the said Respondent Nos.2 & 6 would consider the Application and pass a Speaking Order.
4. Having considered the submission of both the learned Counsel, this Court deems it appropriate to dispose of this Writ Petition, at the admission stage, without going into the merit, directing the Respondent Nos.2 & 6 to consider the Online Application submitted by the Writ Petitioners dated 09.12.2023 (Ex.P.10) and pass a Speaking Order in accordance with law within a period of four (4) weeks from the date of uploading of this Order on the website of this Court and communicate such Speaking Order to the Writ Petitioners forthwith.
5. Needless to state that Respondent Nos.2 & 6 are statutorily obligated to adhere to the principles of Natural Justice by considering the submissions and documents of the Petitioners before passing the Final Order. Writ Petitioners are granted liberty to file Affidavit and documents before Respondent No.2 within a period of one week from today, if so advised.
6. With these observations and directions, this Writ Petition stands
disposed of. No order as to costs.
7. Interlocutory Applications, if any, stand closed in terms of this order.
