GP FOR HOME The Court made the following: THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 17826 OF 2023 ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “…to issue a Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus, declaring the action of the respondents 2 to 4 herein in interfering with the peaceful possession and enjoyment over the petitioner's property to an extent of Ac.2.60 cts, situated in Sy.No.210/7 situated in Iruvaram Village, of Chittoor Mandal, Chittoor District, as illegal, arbitrary and consequently direct the respondents 2 to 4 herein not to interfere with the peaceful possession of the petitioner's property and pass such...…” 2. Heard Sri V.R.Maheswara Rao Paleti, learned counsel for the petitioner, and Sri V. Farooq, learned Assistant Government Pleader for Home. 3. When the matter was taken up for hearing, Sri V. Farooq, learned Assistant Government Pleader for Home, on written instructions, would submit that basing on the complaint of Tahasildar, the 4th respondent has registered a crime against the petitioners in crime No.102 of 2023, for the offences punishable under Section 353 r/w 34 IPC dated 18.04.2023 and subsequently basing upon the complaint of Project Manager, the 4th respondent has registered the case vide Cr.No.202 of 2023 under Section 341, 447, 506 r/w 34 IPC dated 11.07.2023, except the registration of the above crimes, the respondent police are never interfered with the peaceful possession and enjoyment of the petitioner. 4. The learned counsel for the petitioner submits that the Court may pass appropriate orders. 5. Considering the submissions, the Writ Petition is disposed of. However, the police are directed not to interfere in the civil disputes except under due process of law. The police are further directed to follow due process of law in respect of the crimes which is registered against the petitioner. There shall be no order as to costs. There shall be no order as to costs.
