1. Case of the petitioner is that respondent no. 4, his wife, has developed habit of gambling at the instigation of their tenant and she has already suffered huge financial losses in gambling. The petitioner apprehends that his wife would implicate him in false criminal cases and is also bent upon selling the house and shop. Accordingly, the petitioner has prayed for a direction to respondent no. 2- Sub Registrar, Sadar (second) Prayagraj not to allow registration of sale deed of House No. 37D/5K/10B J.K. Ashiyana Kareli, Prayagraj and Shop No. 5, Bajupur, Gaus Nagar, Prayagraj.
2. The petitioner has not filed any evidence to establish, even prima facie, his title over the properties. Rather it is admitted in the application filed before the Sub-Registrar that the property is in the name of his wife. Moreover, no provision has been shown to us where under the Registering Officer could examine title of the parties.
3. The petition is wholly misconceived and a waste of valuable time of the court. Consequently, the petition is dismissed with a cost of Rs. 25,000/- to be deposited by the petitioner before the High Court Legal Services Authority within a week. . (R.M.N. Mishra, J.)
