GP FOR REGISTRATION AND STAMPS (AP) 3 BKM,J W.P.No.7708 of 2021 The Court made the following ORDER: Heard the learned counsel for the petitioners and the learned Assistant Government Pleader appearing for the respondents. 2. This writ petition was filed questioning the action of the 5th respondent in refusing to register the petitioner’s property situated at plot No.42 to an extent 277.77 Sq. Yards, vacant house site and plot No.43 to an extent 277.77 Sq. Yards, vacant house site and plot No.113 to an extent of 183.33 Sq. Yards, vacant house site, Vikrutamalla Village, Erupedu Mandal, Chittoor District, which is in violation of the Indian Registration Act, 1908 and violation of rights guaranteed by the Constitution of India and consequently direct the 5th respondent to receive, register and release the documents for the petitioner’s property vide plot No.42 to an extent 277.77 Sq. Yards, vacant house site and plot No.43 to an extent 277.77 Sq. Yards, vacant house site and plot No.113 to an extent of 183.33 Sq. Yards, vacant house site, Vikrutamalla Village, Erupedu Mandal, Chittoor District. 3. The learned counsel for the petitioners further submits that the petitioners made representation dated 22.08.2025 to the 5th respondent. But, the same is not considered so far. The said representation was also filed through Memo dated 16.09.2025. 4. On the other hand, the learned Assistant Government Pleader appearing for the respondents submits that the petitioner has not submitted any documents even before the 5th respondent for considering the request of the petitioners. 4 BKM,J W.P.No.7708 of 2021 5. In view of the above said facts and circumstances, the petitioners are permitted to make a representation to the respondent Nos.3 to 5, enclosing all the necessary documents in support of their claim with respect to the relief sought in this writ petition within a period of four (4) weeks from the date of receipt of this order. On receipt of such representation, the respondent Nos.3 to 5 are directed to consider and dispose of the same strictly in accordance with law by hearing all the parties concerned including the petitioners, giving due opportunity of hearing, upon verification of the records and the subject land, appropriate decision shall be taken on its own merits. 6. Accordingly, the Writ Petition is disposed of. Interim order, if any, deemed to have been vacated. There shall be no order as to costs.
