As is clear from the aforesaid complaint, it is specifically alleged by the second respondent - complainant that the petitioner is alleged to have assaulted the second respondent during the course of a quarrel and thereby committed the alleged offences. However, after investigation, the first respondent - Police authorities have filed the charge sheet against the petitioner for the alleged offences punishable under Sections 279, 337, 323, 504, 506 of IPC and Sections 3(1), 181, 56, 192, 146, 196 of the IMV, 1988, which is pending in C.C.No.1172/2024 on the file of the learned Principal Civil Judge (Sr.Dn.) & CJM Court, Davanagere District. - 5 - HC-KAR NC: 2025:KHC:27637 CRL.P No. 8613 of 2024 6. A perusal of the impugned FIR/complaint and the charge sheet summary is sufficient to come to the - 6 - HC-KAR NC: 2025:KHC:27637 CRL.P No. 8613 of 2024 conclusion that, while the complainant is very specific and categorical in stating that the petitioner is alleged to have assaulted him during the course of a quarrel, the charge sheet paints a diametrically an opposite and a different picture by stating that the complainant fell down and got injured on account of the acts of the petitioner/accused. In view of this material and patent discrepancy between the complaint/FIR on the one hand and the charge sheet material on the other, I am of the considered opinion that the impugned proceedings deserve to be quashed. 8. In the result, I pass the following: ORDER i. The Criminal Petition is hereby allowed; ii. The impugned proceedings pending in C.C.No.1172/2024 (arising out of Crime No.408/2023 registered by Rural Police Station, xxDavanagere), pending on the file of the learned Principal Senior Civil Judge and - 7 - HC-KAR NC: 2025:KHC:27637 CRL.P No. 8613 of 2024 CJM, Davanagere, for the offences punishable under Sections 279, 337, 323, 504, 506 of IPC and Sections 3(1), 181, 56, 192, 146, 196 of the IMV, 1988, qua the petitioner herein/accused, are hereby quashed.
