1. By way of the present appeal filed under Section 299 of the Indian Succession Act, 1925, the appellant seeks to assail the order dated 29.04.2025 passed by the learned District Judge-02, District South, Saket Courts, New Delhi in Probate Case No. PC/37/2022 whereby the probate petition, filed by the appellant, came to be dismissed for the reason that the appellant herein failed to lead evidence to prove that the Will dated 18.02.2022 was validly and legally executed by the testatrix, Late Chander Mehndiratta.
2. At this stage, learned counsel for the respondents, upon instructions, state that they have no objection if the present appeal is allowed, however the appellant may be subject to some costs for delaying the trial.

impugned order is set aside, subject to costs of Rs.20,000/- (i.e., Rs.10,000/- each) to be paid to respondent nos. 2 and 3 equally within a period of four weeks from today.

5. List before the concerned Trial Court on 18.08.2026.

Learned counsel for the appellant assures that the requisite affidavits of the appellant and the attesting witnesses would be filed before the next date of hearing and no more adjournments would be sought before the Trial Court.
