No. 1190 of 2025 : “…..to issue a writ, order or a direction, more particularly one in the nature of Writ of Mandamus, declaring the action of the 3rd Respondent in issuing proceedings vide D/843/Kakinada Rural/0423038/2025 dt. 01.01.2025 thereby inviting applications for the recruitment of permanent dealers for the Fair Price Shop No. 0423038, Turangi Village, Kakinada Rural Mandal, East Godavari contrary to G.O. Ms. No. 32 Consumer Affairs, Food and Civil Supplies (CS.I) Department dt. 3.12.2018 is illegal, arbitrary and violative of the principles of Natural Justice and consequently set aside the said notification and further direct the respondents to continue the petitioner as a permanent FP shop dealer by regularizing the petitioners authorization and pass such other order or order as this Hon’ble court may deem fit and proper in the circumstances of the case and in the interest of justice.” W.P. No. 21312 of 2024 until further orders as illegal, arbitrary and violative of the principles of Natural Justice and consequently set aside the said notification and further direct the respondents to continue the petitioner as FP shop dealer as usual and pass such other order or order as this Hon’ble court may deem fit and proper in the circumstances of the case and in the interest of justice.” W.P. No. 2549 of 2025 : “…..to issue a Writ of Mandamus or any other appropriate Writ Order or direction declaring the action of the Respondents more particularly the 4th respondent in issuing notification vide Ref. D. CS/P. Gannavaram/56/2025 and Ref. D. CS/P. Gannavaram/55/2025 dated 03.01.2025 is contrary to the Go. Ms. No. 10 dated 03.09.2024 is illegal, arbitrary and violations of Article 14, 19 and 21 consequently set aside the same and pass such other order or order as this Hon’ble court may deem fit and proper in the circumstances of the case and in the interest of justice.” 17 VS,J WRIT PETITION NOs: 31508 of 2024, 46, 555, 1190, 1191 and 2549 of 2025 Since all these writ petitions are filed by temporary fair price shop dealers challenging the notifications issued by the respondent authorities, for appointment of permanent fair price shop dealers, with regard to fixation of the roster point, this court feels it appropriate to dispose of all these writ petitions by way of common order. 2. Heard learned counsel for the petitioner and the learned Assistant Government Pleader for Civil Supplies. 3. Today when these writ petitions came up for hearing, learned Assistant Government Pleader for civil supplies has furnished the copy of instructions of the 3rd respondent vide Ref. No. C/1628/2024, dated 22.11.2025 wherein it is stated that after re-organization of the districts in the year 2022, the boundaries of every division were also changed, and as per the instructions issued through circular dated 11.11.2024 and also as per the guidelines envisaged under G.O.Ms.No.77 dated 02.08.2023, roster points to all the Fair Price Shops existing in different Mandals were fixed duly considering the revenue division as a unit. Accordingly, the roster point for the petitioner’s fair price shop was re-fixed, and accordingly to fill up the existing vacancy of petitioner’s fair price shop on a permanent basis, notifications were published for selection and appointment of dealer to the said existing vacant fair price shops as per the said instructions. 18 VS,J WRIT PETITION NOs: 31508 of 2024, 46, 555, 1190, 1191 and 2549 of 2025 4. The said instructions would specify that, after re-organization of districts in the year 2022, there is change in the number of the Mandals and accordingly as per the guidelines of G.O.Ms.No.77 dated 02.08.2023, the roster points for existing petitioner’s fair price shop have been changed by the government. But, however, it appears that the temporary fair price shop dealer who was running said fair price shop as on the date of issuance of the notification were not put on notice with regard to the change of roster points, because of which they were denied the opportunity of applying in pursuance of the Impugned notifications issued for appointment of fair price shop dealers on permanent basis. 5. As the said roster points were prepared behind the back of the petitioners, this Court, instead of going into merits of the case, feels it appropriate to dispose of all writ petitions by directing the concerned Revenue Divisional Officer / Appointing Authority to exhibit change of roster points by way of a notice affixed on the notice board of the jurisdictional office of the Tahsildar and as well as the Revenue Divisional Officer, which would be visible to each and every person, so as to enable the effected fair price shop dealers to raise objections, if any, before the concerned authorities within a period of fifteen (15) days from the date of exhibiting the said notice in the notice boards. 19 VS,J WRIT PETITION NOs: 31508 of 2024, 46, 555, 1190, 1191 and 2549 of 2025 After receiving the objections from the fair price shop dealers, the concerned Revenue Divisional Officer/ Appointing authority shall consider the same and pass appropriate orders within a period of two (02) weeks thereafter. Consequently, the concerned Revenue Divisional Officer/Appointing Authority shall proceed further for appointment of a permanent fair price shop dealer, by way of issuing a fresh notification. 6. In view of the same, the impugned notifications pertaining to the petitioner’s Fair Price Shop are set aside with a liberty to Revenue Divisional Officer/Appointing Authority to issue a fresh notification after following the above procedure. 7. Accordingly, these Writ Petitions are allowed. There shall be no order as to costs.
