WRIT PETITION Nos.13385 and 2195 of 2020 COMMON ORDER:
Since the issue involved in both the writ petitions is one and the same, this Court is of the opinion that both the writ petitions can be disposed of by way of a common order. 2. W.P.No.13385 of 2020 is filed under Article 226 of the Constitution of India seeking following relief:
“to issue a Writ, order or direction more particularly one in the nature of writ of Mandamus declaring the proceedings Rc.No.D11/57/MGNREGS/20 Dt.29.06.2020 issued by the 3rd respondent constructing Village Secretariat/ Grama Sachivalayam at Itikyala Village instead of Kanakadripalli Village of Kolimigundla Mandal, Kurnool District, Andhra Pradesh as illegal, arbitrary and contrary to the guidelines issued in G.O.Ms.No.110, Panchayat Raj and Rural Development (MDL-I) Department dt.19.07.2019 and pass such other order or orders…..”
3. W.P.No.2195 of 2020 is filed under Article 226 of the Constitution of India seeking following relief:
“..to issue a Writ, order or direction more particularly one in the nature of writ of Mandamus declaring the action of the respondent No.2 in passing impugned proceedings dated 30.12.2019 vide proceedings No.751/CPR & RD/S/2019 Changing the location of the Village Secretariat from Kanakadripally village to Itikyala Village as arbitrary, illegal, violative of Principles of natural

justice and contrary to Art 14, 19, 21 and 300-A of the Constitution of India and to consequently set aside the impugned proceedings dated 30.12.2019 vide proceedings No.751/CPR and RD/S/2019 in the interest of Justice and pass such other order or orders ….”
4. No representation on behalf of the petitioner(s). Heard learned Government Pleader and learned Standing Counsel for the respondents. 5. Since the facts and contentions in both the writ petitions are one and the same, to avoid repetition and for the convenience of the Court the facts mentioned in W.P.No.13385 of 2020 are referred to decide the issue. 6. The case of the petitioners in W.P.No.13385 of 2020 is that the respondent No.3 herein issued impugned proceedings dated 29.06.2020 proposing for construction of a Village Secretariat at Itikayala Village instead of Kanakadripalli Village of Kolimigundla Mandal, Kurnool District contrary to the terms of the G.O.Ms.No.110, Panchayat Raj and Rural Development (MDL-I) Department dt.19.07.2019. Hence, the Writ Petition. 7.
The further case of the petitioners herein is that at the time of admission, on hearing both the learned counsel, this Court was pleased to pass an interim order dated 13.08.2020 which reads as follows:

“As prima-facie is made out by the learned counsel for the petitioners, there shall be an order of status quo with regard to the construction of Grama Sachivayalam at Itikyala Village, for a period of six (06) weeks.”
8. On the other hand, learned Government Pleader furnished written instructions dated 20.08.2025 issued by respondent No.4. The operative portion of the said instructions is extracted hereunder:
“It is humbly submitted that the petitioner has filed WPs for changing of Grama Sachivalayam from Kanakadripally to Itikayala village of Kolimigundla Mandal and construction of Grama Sachivalayam Building in Itikyala Village of Kolimigundla Mandal. But, as per the report of the MPDO, MPP, Kolimigundla, it is submitted that neither Gramasachivalayam of Kanakadripally village of Kolimigundla Mandal shifted to Itikyala Village of Kolimigundla Mandal. Therefore, it is humbly prayed that this Hon’ble Court may be pleased to dismiss the above writ petition and pass such other order or orders as this Hon’ble Court may deem fit and proper and circumstances of the case.”
9. He further submits that in view of the interim orders of this Court, the Village Secretariat was neither constructed at Itikyala village nor shifted from Kanakadripally village, Kolimigundla Mandal to Itikyala

Village as alleged by the petitioners. Therefore, no further orders are necessary and the writ petition is liable to be dismissed. 10. Considering the submissions made by both the learned counsel and on perusal of the material placed on record and in view of the clear and categorical admission on part of the respondents, it is evident that the village Secretariat not shifted from Kanakadripally Village, Kolimigundla Mandal to Itikyala Village. As such, the grievance of the petitioners is redressed and no further orders are required to be passed in these writ petitions. 11. With the above observations, these writ petitions are closed.
There shall be no order as to costs. As a sequel, miscellaneous petitions, if any, pending shall stand closed. _________________________________
