Heard learned counsel for applicant and the learned A.G.A. for the State. 2. This application u/s 528 BNSS has been filed for quashing of the entire proceedings, including summoning order dated 21.06.2024, of Complaint Case No. 375 of 2024 (Vijay Laxmi Singh v. Upendra Vikram Singh) under Section 125 CrPC, pending in the court of Principal Judge, Family Court, Chandauli. 3. It is submitted by learned counsel for the applicant that applicant is husband of opposite party no.2 and their marriage was taken place way-back in the year 1982. The opposite party no.2 has filed aforesaid case under Section 125 CrPC claiming maintenance, wherein notice has been issued to the applicant by the Family Court, Chandauli. It was submitted that as both the parties are senior citizens and there is possibility of compromise between the parties and thus, the matter may be referred for mediation. It was stated that so far, only notice has been issued to the applicant and no order of interim maintenance has been passed. 4. In view of the aforesaid, it is provided that in case applicant moves an application before the Family Court concerned for referring the matter to mediation before the Mediation Centre of District Court concerned, the same shall be considered and decided expeditiously and considering the fact that long time has been passed after marriage of the parties and both the parties are senior citizens . 5. With the aforesaid observations/ directions, this application u/s 528 BNSS is disposed of finally.
