The present petition has been filed under Section 483 BNSS, 2023 for grant of regular bail to the petitioner in case bearing FIR No.112 dated 18.10.2024 (Annexure P-1) under Sections 103(1), 109, 351(2), 3(5) BNS, registered at Police Station Mehatiana, District Hoshiarpur. 2. Custody certificate dated 19.05.2025 filed on behalf of the respondent-State is taken on record. As per the custody certificate, the petitioner has undergone 06 months and 27 days of actual custody. 3. As per the prosecution story, on 18.10.2024 at about 8.30 pm, the petitioner-Amrik Singh and his son-Harpal Singh came into the street in front of the complainant's house. The co-accused-Harpal Singh started bursting crackers in the street and raised a lalkara and hurled abuses at them. The husband of the complainant enquired from the petitioner and his co-accused as POONAM BHATT 2025.05.22 18:31 I attest to the accuracy and authenticity of this order/judgment CRM-M-26564-2025 (O&M) 2 to why they were abusing. At the instance of the petitioner's son, the husband of the complainant went into the street. It is further alleged that the petitioner and his co-accused-Harpal Singh grappled with the husband of the complainant, pushed him and he fell into the drain. The co-accused struck him on the head, chest and stomach with a screw driver, ultimately leading to the complainant's husband's death. 4. Learned counsel for the petitioner contends that the petitioner has been falsely implicated in this case and he is in custody since 18.10.2024. He further contends that neither any overt act nor any injury has been attributed to the petitioner. The petitioner is 70 years of age. He submits that no weapon was recovered from the petitioner. The conclusion of trial is going to take time. 5. Learned State counsel has opposed the petition on the ground of gravity of allegations against the petitioner. Learned State counsel has confirmed that during the investigation, no recovery of any weapon was effected from the petitioner. Learned State counsel confirms that investigation is complete and final report under Section 173 Cr.P.C. has also been presented before the trial Court. Learned State counsel further confirms that there is no history of any other case against the petitioner. 6. I have heard learned counsel for the parties and have also gone through the paper-book. 7. Keeping in view the age of the petitioner and considering the fact that no recovery has been effected from him; he is not having any other criminal antecedents and conclusion of trial is going to take time, the present petition is allowed.
