(ORAL) The instant petition has been filed by the petitioner for claiming selection on the post of Clerk pursuant to the Advertisement No.05/2019 on the ground that she has secured more marks than the last selected candidate in her category i.e. SC-PwD and that she is entitled to weightage of 05 marks on account of her belonging to the Vimukht Jaati. Reply on behalf of the respondents had been filed in the month of October 2023, wherein it has been specifically averred that the petitioner has scored 60 marks as against the last selected candidate who has scored 62 marks and the person kept in waiting list has scored 61 marks. It has also been specifically averred therein that the benefit of weightage of 05 marks on account of the petitioner belonging to Vimukht Jaati cannot be extended to her since a specific resolution dated 02.03.2022 has already been passed by the Haryana Staff Selection Commission to the effect that the de-notified tribes, who have already availed the benefit under SC/ST Caste or Backward Class as per the notification issued by the State, cannot be extended additional benefit.
