1. The present CRMP has been filed by the petitioner with the following prayer :-
“It is therefore, prayed that this Hon'ble Court may kindly be pleased to quash the FIR in crime No. 0097/2023 registered at Police Station Dhamtari, District- Dhamtari (C.G.) for the alleged offence punishable under Section 406, 409, 420 of IPC in the interest of justice.”
2. At the very outset, learned counsel for the petitioner would submit that the charges have been framed against the present petitioner by the concerned trial Court. He further submits that evidence of 03 prosecution witnesses have been recorded hence, he seeks permission of this Court to withdraw this petition with liberty to take appropriate recourse to law.
3. Learned State counsel has no objection.
4. In view of the submissions made by learned counsel for the petitioner, the present petition is dismissed as withdrawn with the aforesaid liberty, as prayed for.
