This is the first bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 397/2025 registered at Police Station – Ambikapur Dehat (Gandhinagar), District – Surguja (C.G.) for the offence punishable under Sections 317 (4), 318 (4), 61 (2) of the Bharatiya Nyaya Sanhita, 2023. 2. Case of the prosecution, in brief, is that the complainant lodged report in the Police Station – Gandhi Nagar, District – Surguja alleging that the applicant had cheated the complainant on the false pretext of providing loan and had duped the applicant for an amount of Rs. 25,000/-. On the basis of the complaint, FIR was lodged and during investigation a suspicious mobile no. bearing 6267424075 to be linked with a bank account no. SHUBHAM DEY Digitally signed by SHUBHAM DEY 2 13011001000015180 of Punjab National Bank and the applicant was found to be the holder of the bank account in which, the amount of Rs. 25,000/- was found to be deposited on 23.01.2025. During investigation, it was found that the applicant along with other co-accused persons used to commit cyber fraud with several persons and the police identified and arrested the accused persons and the investigation is still going on. 3. Learned counsel for the applicant submits that the applicant is innocent, he has not committed any offence as alleged. He submits that there is no material available against the applicant and he has been arrested without any specific allegation and evidence available against him. So far as the criminal antecedent is concerned, there is no other criminal antecedent against the applicant. He is in jail since 14.07.2025 and the conclusion of trial is likely to take some time, therefore, he prays for releasing the applicants on regular bail. 4. Learned counsel for the State/non-applicant opposes the bail application and submits that the prima facie there is material available against the applicant showcasing to be involved in commission of offence under Sections 317 (4), 318 (4), 61 (2) of the Bharatiya Nyaya Sanhita, 2023. He further submits that in compliance with this Court's order dated 12.09.2025, whereby the Superintendent of Police, District - Surguja, was directed to file personal affidavit stating the evidence collected during the course of investigation against the applicant in this regard, the Superintendent of Police, District - Surguja, has submitted his affidavit stating that Mr. Vinay Kumar Tyagi, resident of North Delhi (Cyber Report Acknowledgment No. 20801250007909) ‒ in which, on 23.01.2025 Rs 25,000 was remitted into bank account No. 1301100100015180 of Ravi Kumar Manjhi (PNB) and on 24.01.2025 Rs 27,380 into account No. 922020026736144 of Dheeraj Kumar Singh (Axis Bank) via mobile number 6267424075 (SIM in name of Sahil Masuri). 3 5. During investigation, Manjhi and Singh admitted to providing their bank accounts for a grocery store and paan-stall respectively to the main accused Amit Kumar Mishra @ Pehlu, who runs a cricket-betting syndicate for financial gain. They were arrested on 15.07.2025; Amit Mishra was arrested 25.07.2025 in a related case and is in judicial custody. The fraud proceeds were later layered and transferred through other bank accounts (including one in the name of Harish Kumar Biwani, Pune branch) with continuous withdrawals, account opening on 02.08.2024 using the SIM 6267424075 under Sahil Masuri’s name, and deposits/withdrawals totaling Rs 32,55,571 between 15.08.2024 and 28.01.2025. A charge-sheet bearing no. 379/2025 dated 09.10.2025 has been filed under Bhartiya Nyaya Sanhita, 2023 for the offence under Sections 317(4), 318(4), 61(2), and subsequently, offence under Sections 238 & 111 were added and further investigation into the syndicate’s bank accounts and property is ongoing. The investigation is pending and there are ample chances of collecting evidence against the applicant. Considering the seriousness of the offences, the risk of tampering with evidence, and the prima facie material collected, it is submitted that the bail application deserves to be dismissed. 6. I have heard learned counsel for the parties and perused the case diary. 7. Considering the facts and circumstances of the case, submission of counsel for the respective parties and furthermore, considering the gravity and seriousness of this case and it cannot be a case of false implication, furthermore, considering the affidavit submitted by the Superintendent of Police, District – Surguja stating that charge-sheet bearing no. 379/2025 dated 09.10.2025 has been filed under Bhartiya Nyaya Sanhita, 2023 for the offence under Sections 317(4), 318(4), 61(2), 238 & 111 and further investigation into the syndicate’s bank accounts and property is ongoing, this Court is of the view that it is not a fit case to enlarge the applicant on bail. 8. Accordingly, the second bail application of the applicants – Ravi Manjhi, 4 involved in Crime No. 397/2025 registered at Police Station – Ambikapur Dehat (Gandhinagar), District – Surguja (C.G.) for the offence punishable under Sections 317 (4), 318 (4), 61 (2) of the Bharatiya Nyaya Sanhita, 2023, is rejected at this stage. 9.
