2 r TCDSJ W.P.No.4100 of 2020 The Court made the following Order: The present writ petition is filed questioning the action of the respondents in trying to dispossess the petitioner from the land admeasuring an extent of Ac. 1.29 cents in Sy.No.335-2 of Bukkapuram Village, Mahanandi Mandal District, without issuing any notice and without following process of law. 1. It is the case of the petitioner that initially the father of the petitioner, who was the freedom fighter of land admeasuring an extent of Ac.9.49 cents i was in possession in various survey number of Bukkavaram Village. It is further case of the petitioner that part of the land possessed by his father was acquired for the purpose of the Telugu Ganga Project’. It is further stated that after demise of his father, the land possessed by his father partitioned between the petitioner and his brother. In the said was partition, the subject land i.e., an extent of Ac. 1.29 cents i Sy.No.335-2 and an extent of Ac.0.75 in cents in Sy.No.237/1A were devolved on the petitioner. It is further case of the petitioner that when the land was notified under the prohibited properties list issued under Section 22-A(1) of the Registration Act, 1908, the petitioner claims that he made nd a representation to the 2 SI

Upon which, the 2^^ respondent called for a report from the 4^'^ respondent and accordingly, a report dated 04.04.2018 was submitted by the 4*'^ respondent recommending to delete the subject land from the prohibited properties list. It is further stated that, when the matter is pending consideration, the 4^'^ respondent tried to interfere with the possession of the petitioner over the subject land on the ground that the land is required for the distribution of house site pattas to the eligible beneficiaries under ‘Navaratnalu Pedalandariki lllu Scheme’. It is th further case of the petitioner that despite requesting the 4 respondent by producing all relevant documents in respect of his claim, the 4*^ respondent continued to interfere with his possession. Therefore, the petitioner approached this Court by filing the present writ petition. 3. When the matter is taken up for hearing, learned Government Pleader for Revenue placed instructions dated 16.04.2025 furnished by the 4*'' respondent. On perusal of the said instructions, it is stated that though the subject land was initially proposed for distribution of house site pattas under ‘Navaratnalu Pedalandariki lllu Scheme’, subsequently, the respondents have identified alternative lands for the said
