IN THE HIGH COURT OF JHARKHAND AT RANCHI A.B.A. No.1139 of 2025 ------ Ashok Mahato @ Ashok Kumar Mahto aged about 39 years son of Prafullya Mahato, resident of Telidih Side, Chas, P.O. & P.S. Chas, Dist.-Bokaro .... .... …. Petitioner Versus The State of Jharkhand .... .... .... Opposite Party ------ CORAM : HON'BLE MR. JUSTICE ANIL KUMAR CHOUDHARY ------ For the Petitioner : None For the State : None ------ Order No.02 Dated- 20-02-2025 No one turns up on behalf of either of the parties in-spite of repeated calls. Apprehending his arrest in connection with Balidih P.S. Case No.106 of 2024 instituted under Sections 414/34 of the Indian Penal Code, the petitioner has moved this Court for grant of privileges of anticipatory bail. Perusal of the record reveals that the allegation against the petitioner is that iron scrap was going to the Godown of the petitioner being loaded on a Tata Magic Vehicle which was seized by the police. Perusal of record further reveals that it has been contended in the anticipatory bail application that the petitioner has been implicated in this case on the basis of the statement of co- accused Anup Kumar Gupta. It is averred in the anticipatory bail application that the petitioner received notice under Section 41A of the Cr.P.C and has also replied to the same and the copy of the same is annexed at Annexure-3 of the Anticipatory Bail Application. It is further averred in the anticipatory bail application that the allegation against the petitioner is false. It is next averred in the anticipatory bail application that the petitioner has no criminal antecedent as mentioned in paragraph no.11 of the anticipatory bail application. It is also averred in the anticipatory bail application that the petitioner is ready and willing to abide by any terms and condition as imposed by this Court. Considering the aforesaid facts of the case, I am inclined to grant privileges of anticipatory bail to the petitioner. Accordingly, the petitioner is directed to surrender in the Court below within six weeks from today and in the event of his arrest or surrendering, he will be enlarged on bail on depositing Rs.10,000/- as cash security and on furnishing bail bond of Rs.25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Bokaro in connection with Balidih P.S. Case No.106 of 2024 with the condition that he will co-operate with the investigation of the case and appear before the investigating officer as and when noticed by him and furnish his mobile number and photocopy of the Aadhar Card with an undertaking he will not change his mobile number during the pendency of the case and further conditions as laid down under Section 482 (2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
