Hon'ble Harvir Singh,J. 1. Chief Judicial Magistrate, Varanasi, vide his letter dated 23.07.2018, has informed this Court that the sole appellant Sharda has already passed away on 25.03.2016. 2. In verification of his death, the death certificate issued by Government of U.P. has been handed over by Smt. Kutura Devi, wife of the deceased Sharda, who has informed that her husband has already passed away on 25.03.2016. The police report has also been submitted. 3. In view thereof, since the sole appellant Sharda, has already passed away, the instant appeal is dismissed as abated. 4. Record be sent back to the trial court, concerned.
