Hon’ble Mr. Justice Naresh Kumar Chandravanshi Order on Board 21/08/2025 1. This writ petition under Article 226 of the Constitution of India has been preferred seeking following reliefs :- 2 “10.1 The Hon’ble Court may kindly be pleased to direct the respondent authority to issue order of superannuation to the petitioner at the earliest. 10.2 The Hon’ble Court may kindly be pleased to direct the respondent authorities to finalize pension case of the petitioner and issue pension payment order without any delay. 10.3 The Hon’ble Court may kindly be pleased to direct the respondent authorities to pay interest on delayed payment of retiral dues from 01.4.2018 till the date of realization at the rate of 18 percent per annum ; and 10.4 The Hon’ble Court may kindly be pleased to direct the respondent No. 1 to take appropriate departmental action against the erring officer in accordance with law. 10.5 Any other relief, which this Hon’ble Court deems fit and proper, may also be awarded to the Petitioner including the cost of the petition. 2. At the outset, learned counsel appearing for the petitioner would submit that though all retiral dues including pension have been paid to the petitioner, but, interest on the aforesaid dues has not been paid to him, therefore, it is prayed that interest may be permitted to be paid to the petitioner on the aforesaid delayed payment of retiral dues. 3. Learned counsel for the State raised formal objection to the prayer as sough for by the petitioner. 4. Having heard learned counsel for the parties, having regard to the facts & circumstances of the case, this petition stands disposed of granting liberty to the petitioner to file fresh petition with due pleadings, if he wishes to claim interest part on the belated payment of retiral dues. 5. With the aforesaid observation & direction, the writ petition stands disposed of.
