THE HONOURABLE SRI JUSTICE RAVI NATH TILHARI THE HONOURABLE SRI JUSTICE MAHESWARA RAO KUNCHEAM CIVIL MISCELLANEOUS APPEAL NOS: 730 & 743 of 2012 COMMON JUDGMENT: (per Hon’ble Sri Justice Ravi Nath Tilhari) C.M.A.No.743 of 2012 is filed challenging the common judgment dated 28.03.2012 passed in O.S.No.254 of 2010 by the learned XI Additional District Judge (F.T.C), Guntur at Tenali. 2. The suit O.S.No.254 of 2010 was filed for declaration of the judgment and decree in Cause No.296-51937-2010 in the 296th District Court of Collin Country, Texas, U.S.A. as null, void, unenforceable, and for perpetual injunction restraining defendant from remarriage while the marriage between plaintiff and defendant was subsisting. The suit was decreed declaring the decree passed in the Cause by the 296th District Court of Collin Country, Texas, U.S.A. as null and void. 3. So far, C.M.A.No.730 of 2012 is concerned, the same was filed challenging the same judgment dated 28.03.2012 by which G.W.O.P.No.1111 of 2010 was also decided. The G.W.O.P. was allowed. 4. Learned counsels for the parties submit that the parties are living together since 2017 at Hyderabad and consequently, there is no need to proceed with the appeal. 5. Since parties are living together, C.M.A.No.743 of 2012 is dismissed as infructuous. 6. Learned counsels for the parties further submit that during pendency of the appeal, minor child has now attained majority. 7. C.M.A.No.730 of 2012 is therefore also dismissed as infructuous. No order as to costs.
