2. The petitioners seek regular bail in a case registered for the offence under Sections 126(2), 115(2), 118(1), 109, 303(2), 352 and 3(5) of the Bharatiya Nyaya Sanhita, 2023.
3. As per the prosecution case, the petitioners are accused of assaulting the informant and his family members with lathi, danda etc., causing injury.
4. Learned counsel for the petitioners submits that the petitioners are innocent and have committed no crime. There is a counter case also. The petitioners are in custody since
Patna High Court CR. MISC. No.45258 of 2025(2) dt.30-07-2025 2/2 17.05.2025 having clean antecedent.
5. Learned A.P.P. has vehemently opposed the prayer for bail.
6. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.
7. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Saran at Chapra/concerned Court below in connection with Dariyapur P.S. Case No. 242 of 2025 subject to conditions that:- (i). The petitioners will mark their attendance at the Dariyapur Police Station on the first & third Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioners. (ii). At the time of accepting the bail bonds of the petitioners, the Court below shall verify the fact whether the petitioners have clean antecedent or not. If it is found that the petitioners have clean antecedent then only the bail bonds of the petitioners shall be accepted by the Court below.
