This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“…to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus declaring the denial to issue of electronic patta related to land to an extent of acres 04.95 cents situated at Jaladurgam village, Peapully Mandal, Nandyala District are contrary to articles 14,21 and 300(A), to the provisions of revenue laws and consequently to direct the respondents to issue the relevant electronic patta related to land to an extent of acres 04.95 cents situated at Jaladurgam village, Peapully Mandal, Nandyala District to the 1st petitioner forthwith…”
2. Heard learned counsel for the petitioner, learned Assistant Government Pleader for Revenue and learned Assistant Government Pleader for Forest appearing for respondents. 3. The fact remains that the petitioner has not filed any application before the competent authority/Settlement Officer. There is a rival claim made by the Forest Department. In the said circumstances, the appropriate forum is the competent Civil Court. 4. Accordingly, the writ petition is dismissed. No costs.
