GP FOR HOME (AP) The Court made the following: 3 THE HONOURABLE SRI JUSTICE B.V.L.N.CHAKRAVARTHI WRIT PETITION No.7399 of 2019 ORDER: The present Writ Petition is filed under Article 226 of the Constitution of India for the following relief: “…to issue a writ, order or direction, more particularly one in the nature of a WRIT OF MANDAMUS, declaring the action of the 3rd Respondent in harassing me by frequently calling and insisting that I visit the Police Station of the 3rd Respondent, and in not allowing me to move freely and objecting to my every act, and in insisting that I settle the civil dispute pending before the Court of the learned Junior Civil Judge, Jammalamadugu in O.S. No. 175 of 2018, and their impugned action in Crime No. 22 of 2019, and in frequently interfering with my peaceful living and liberty, as illegal, irregular, irrational, without any authority of law and violative of Articles 14 and 21 of the Constitution of India, and consequently direct the 3rd Respondent not to interfere in any manner with my liberty and peaceful living…” 2. Heard learned counsel for the petitioner and Sri R. Mallikarjuna Rao, learned Assistant Government Pleader for Home, appearing on behalf of respondent Nos. 1 to 3. 4 3. Learned Assistant Government Pleader for Home, on written instructions, submits that the dispute is civil in nature. The writ petitioner filed a complaint before the learned Judicial Magistrate of First Class at Jammalamadugu, and a case in Crime No. 22 of 2019 was registered against the 4th respondent. After enquiry, the police found that the matter relates to a civil dispute and that they would not interfere in such matters. It is further submitted that the petitioner filed the present writ petition with false allegations. 4. Learned Assistant Government Pleader further submits that the dispute between the parties is civil in nature and that the respondents would not interfere in the matter. 5. Considering the facts and circumstances of the case, the Writ Petition is closed at the admission stage without going into the merits of the matter. There shall be no order as to costs. As a sequel thereto, interlocutory applications, if any, pending in this Writ Petition shall stand closed. ______________________________ JUSTICE B.V.L.N.
