ORDER ON BOARD 19 /12/2025
1. On an objection being raised by learned counsel for State that on filing of an appeal under Section 44(1) of the Chhattisgarh Land ALFIZA BAIG Digitally signed by ALFIZA BAIG Date: 2025.12.19 17:31:52 +0530
2 Revenue Code, 1959, petitioner is having a remedy of appeal against the order of eviction passed under Section 248 of the Code of 1959.

At this stage, learned counsel for petitioner submits that he may be permitted to withdraw this petition with liberty to avail the remedy available to him of filing of an appeal, he however submits that under the provision of Code of 1959 period of limitation is of 45 days and, therefore, some interim protection with regard to possession of land, which is subject matter of this petition Annexure P-1 be granted.
3. Upon this, learned counsel for State submits that the order is of 10.12.2025 and till now petitioner has not filed any appeal.
4. In view of the submission made by learned counsel for the respective parties, this writ petition stands dismissed as withdrawn with liberty as prayed for, however considering the fact that eviction
order dated 10.12.2025 and writ petition is filed on 12.12.2025, it is
directed that petitioner shall not be removed pursuant to the order dated 10.12.2025 for a further period of 3 weeks from today, enabling him to file an appeal along with the application for interim protection. C.C.Today. sd/- (Parth Prateem Sahu) alfiza Judge
