AND OTHERS .....RESPONDENTS CORAM: HON'BLE MR. JUSTICE SANDEEP MOUDGIL Present: Mr. S.K. Sirsa, Advocate for the petitioner. Mr. Chetan Sharma, DAG, Haryana. SANDEEP MOUDGIL, J (ORAL) The jurisdiction of this Court has been invoked under Articles 226/227 of the Constitution of India for issuance of a writ in the nature of Habeas Corpus, for directing respondents No.2 to 3 to release the detenue namely Simran Rani Singh, who is in the illegal custody of respondents No.4 & 5 and to be handed over to the petitioner. Today, counsel for the petitioner would submit that his clients were not in a position to bear the expenses i.e. approximately Rs.10,000/- towards the fee of Warrant Officer and the transport expenses but at the same time, Mr. Chetan Sharma, DAG, Haryana informs the Court that the alleged detenue namely Simran Rani Singh stands recovered and her statement under Section 183 of BNSS has been recorded and has been kept at a protection home at Sirsa since she desired not to accompany her parents, which fact has not been denied by learned counsel for the petitioner.
