ORDER ON BOARD 09 /12/2025
1. The petitioner has filed this writ petition seeking following reliefs:-
“10.1 That, the Hon’ble Court may kindly be pleased to issued appropriate writ by setting-aside /quash the impugned order dated 16.10.2025 (Annexure P-1) passed by the respondent No. 2. 10.2 That, this Hon'ble Court may kindly be pleased to issued appropriate writ by directing the respondent No. 2 to decide the case/ appeal after deciding the interim and substantial applications. 10.3 That, this Hon'ble Court may kindly be pleased to issued appropriate writ by directing the respondent No. 2 to issue notice to the state government to participate in the case/appeal. 10.4 That, this Hon'ble Court may kindly be pleased to issued appropriate writ to the respondent No. 1/ The Secretary Department Of Revenue And Disaster Management to conduct enquiry and disciplinary action against the respondent No. 8 looking to the
facts and circumstances of the present case. 10.3 That, this Hon'ble Court may kindly be pleased to issue any other suitable writ/orders/directions in favour of the petitioner looking to the facts and circumstances of the case.”
2. On objection being raised by the counsel for the Respondent/State that the petitioner is having the alternate efficacious remedy under the Chhattisgarh Land Revenue Code, 1959 (hereinafter for brevity referred to as the Code, 1959) for redressal of his grievance as raised in this writ petition, after arguing for sometime, learned counsel for the petitioner submits that he may be permitted to withdraw this writ petition at this stage with liberty to avail the other remedy available under the provisions of the Code, 1959.

On due consideration of the submission of counsel for the respective parties, in view of the above, this writ petition is dismissed as withdrawn at this stage, reserving liberty with the petitioners to avail the alternate remedy available under the Code, 1959. Registry is directed to return back the certified copies of the documents enclosed along with the writ petition after retaining photocopies of the same.
