NARENDRA PRASAD ORAL ORDER This writ petition is filed under Articles 226 & 227 of the Constitution of India, challenging the order dated 14.09.2021 (Annexure-Q) passed by the appellate authority and also the order dated 23.10.2017 passed by the disciplinary authority vide Annexure-M. 2. The case of the petitioner is that the petitioner was working as Senior Assistant, Finance Section of the respondent – University. At that time, a departmental enquiry has been initiated. Being aggrieved by the same, the petitioner filed an appeal before the appellate authority. The appellate authority, by order dated 14.09.2021 (Annexure-Q), confirmed the order passed by the disciplinary authority. Being aggrieved, the petitioner has filed this writ petition. 4. The learned counsel appearing for the petitioner submits that as per the impugned order dated 23.10.2017 (Annexure-M), the petitioner’s pay has been reduced to initial pay. Except that, there is no penalty imposed for recovery of any amount. Inspite of that, the respondents are deducting Rs.25,000/- per month from the salary of the petitioner and also withdrawing 11 increments. The same is contrary to the order dated 23.10.2017. He further submits that he is not pressing the other reliefs sought for in this writ petition. 5. Under these circumstances, the petitioner is at liberty to submit a representation to the respondents in respect of deducting the amount from the petitioner’s - 5 - HC-KAR NC: 2025:KHC:32947 WP No. 23044 of 2021 salary. If such a representation is submitted, the respondents are directed to consider the same and pass appropriate orders in accordance with law. 6.
