2 THIS CRL.RP IS FILED U/S 397 R/W SECTION 401 OF CR.P.C PRAYING TO SET ASIDE THE JUDGMENT AND ORDER DATED 16.10.2021 PASSED BY THE II ADDITIONAL DISTRICT AND SESSIONS JUDGE, DAVANAGERE IN CRL.A.NO.18/2017 DISMISSING THE APPEAL AND CONFIRMING THE JUDGMENT AND ORDER OF CONVICTION DATED 21.01.2017 IN C.C.NO.536/2011 PASSED BY THE LEARNED PRINCIPAL CIVIL JUDGE AND JMFC HARIHARA AND DISMISS THE COMPLAINT IN C.C.NO.536/2011 AND FURTHER PASS AN ORDER OF ACQUITTAL IN FAVOUR OF THE PETITIONER. THIS PETITION COMING ON FOR CONCILIATION BEFORE NATIONAL LOK ADALAT, THE FOLLOWING CONCILIATION ORDER IS PASSED. CONCILIATION ORDER
The learned Counsel appearing for the petitioner and the learned Counsel appearing for the respondent are present and the respective parties are also present. 2. Heard the learned counsel appearing for the respective parties. 3. The petitioner and the respondent along with their respective counsel have filed the joint memo for settlement for an amount of Rs.3,15,000/-. The petitioner submits that he has deposited Rs.2,05,000/- before the trial Court. The same is permitted to withdraw by the respondent. The trial Court shall release the said amount in favour of the respondent after following due procedure. Today, petitioner has transferred a sum of Rs.25,000/- to the account of the respondent and the same is acknowledged by the respondent. The balance of Rs.85,000/- would be paid before 15th of September 2025. If petitioner fails to pay the balance amount
3 before 15th of September 2025, this Crl.R.P. will be revived for consideration on merits. 4. In view of the compromise entered between the parties, this revision petition is closed and the petitioner is acquitted for the offence punishable under Section 138 of N.I. Act. 5.
The judgment and order dated 16.10.2021 passed by the II Additional District and Sessions Judge, Davanagere in Crl.A.No.18/2017 dismissing the appeal and confirming the judgment and order of conviction dated 21.01.2017 in C.C.No.536/2011 passed by the learned Principal Civil Judge And JMFC, Harihara is hereby set aside. The Application filed by the petitioner under Section 147 of NI Act is allowed. The conviction order is set aside and surety stands discharged. Sd/- JUDGE
