During the pendency of the proceedings, parties state that the dispute regarding revenue entries could be disposed of by making suitable directions after taking note of the adjustment of substantive rights. 3. A compromise petition is filed which reads as hereunder: "UNDER ORDER 23 RULE 3 OF CODE OF CIVIL PROCEDURE READ WITH SECTION 151 OF CODE OF CIVIL PROCEDURE AND ARTICLE 226 OF CONSTITUTION OF INDIA The petitioner and respondents 6 to 10 submit as follows: 1. The petitioner being aggrieved by order dated 20.05.1994 passed in MR 39/1993-94 at Annexure-B, Order dated 06.04.2016 passed in RRT(A)250/2012-13 at Annexure-E and order dated 19.02.2025 passed in RP 83/2023 at Annexure-G have filed the above petition. During the pendency of the above petition at the - 5 - HC-KAR NC: 2025:KHC:48275 WP No. 13327 of 2025 intervention of well wishers and friends, the parties have decided to settle the dispute amicably to put a quietus to the litigation. 2. The petitioner and respondents 6 to 10 submit that, they have agreed to settle the schedule properties in the following manner: A - SCHEDULE ALLOTTED TO PETITIONER (SMT SAKAMMA) a) Land measuring 0.20 guntas in Sy. No. 3/2 of Doddamaragowdanahalli Village, Illwala Hobli, Mysore Taluk and bounded as follows. East By: - Lands belonging to Moogishivaraj Nayak, Javre Gowda and Basavegowda West By: - Remaining Land of M.K.Sannegowda North By:- Lands belonging to Shankar Rao and Smt. Prema South By:- Lands belonging to Kendeganniah and Smt. Gowramma B - SCHEDULE ALLOTTED TO RESPONDENT 6 TO 10 a) Land measuring 0.29 Guntas in Sy. no. 3/2 measuring 0.29 Guntas of Doddamaragowdanahalli Village, Illwala Hobli, Mysore Taluk and bounded on East By:- Lands belonging Smt. Sakamma W/o. Late Kunnalakkegowda West By:- Road North By:- Lands belonging to Swamy Gowda and - 6 - HC-KAR NC: 2025:KHC:48275 WP No. 13327 of 2025 Rachegowda South By:- Lands belonging to Smt. Gowramma, Nanjaiah and Dollegowda 3. The respondent 6 to 10 have paid Rs.1,00,000/- (One Lakh Only) in cash in advance agreed to pay a sum of Rs.1,00,000/- (One Lakh Only) in lieu of 0.09 guntas of excess land allotted to them, by means of Account Payee DD bearing No. 806495 dated 07/11/2025 drawn on Canara Bank, Vijayanagara 4th Stage, Mysore Branch. 4. The parties submit that, this compromise is entered into between the parties in full and final settlement of their claims over the scheduleproperty, out of their free will, volition and wish and there is no coercion, fraud or undue influence on any party by anybody else. WHEREFORE, this Hon'ble Court be pleased to accept the compromise petition and dispose of the petition in terms of the compromise petition by modifying the impugned orders in MR 39/1993-94, dated 20.05.1994, passed by the respondents 5, at annexure-B, Order dated 06.04.2016 passed by 3rd respondent in case No.RRT(A) 250/2012-13 at Annexure-E and the order dated 19.02.2025 passed in RP 83/2023 RD0050000485015) by the 2nd respondent at Annexure-G and further direct the respondent No.4 Tahsildar Mysore Taluk to - 7 - HC-KAR NC: 2025:KHC:48275 WP No. 13327 of 2025 effect mutation and enter the revenue entries in the names of the parties schedule properties respectively as indicated above with no order as to costs in the interest of justice and equity." 4. It is noticed that there are certain terms in the compromise petition and the parties have adjusted their rights inter-se insofar as Schedule - A and B as mentioned in the compromise petition. Further, it is stated that respondent 6 to 10 have paid a sum of Rs.1,00,000/- in cash and have also paid an amount of Rs.1,00,000/- by way of demand draft in lieu of 0.09 guntas of excess land that has been allotted to them. 5. The parties who are present before the Court submit that they have understood the terms of the compromise. Accordingly taking note of the adjustment of rights as reflected in the compromise, the Court has recorded the compromise. 6. In terms of the compromise, revenue entry in MR No. 39/1993-94 dated 20.05.1994 passed by - 8 - HC-KAR NC: 2025:KHC:48275 WP No. 13327 of 2025 respondent No. 5, the Order dated 06.04.2016 in RRT(A)250/2012-13 and the Order dated 19.02.2025 passed in R.P. No.83 of 2023 would require to be modified after taking note of adjustment of rights as reflected in the compromise petition. The Tahsildar, Mysore who is respondent No. 4 to take note of the compromise and effect mutation and enter revenue entries in the names of the parties as indicated in the compromise petition. 7. Parties report receipt of cash and Demand Draft as mentioned in the compromise deed. Parties to affix their signatures in the order sheet. 8. Accordingly, petition is disposed of.
