JUSTICE MOHAMMAD NAWAZ ORAL ORDER Heard the learned counsel for petitioner, learned High Court Government Pleader for the State and perused the material on record. 2. Petitioner/accused No.1 in Crime No.119/2025 of Tumakuru Women Police Station, registered for the offence punishable under Section 376, 417, 506, 504 r/w 34 of IPC, has preferred this petition under Section 483 of BNSS, 2023, to enlarge him on bail. 3. The complaint is lodged by the victim. It is averred in the complaint that she was working in LM Window Company. She got acquainted with the petitioner, in the year 2023. Petitioner with a promise of marriage, committed sexual intercourse with her on several occasions and in the year 2025, when her mother wanted - 3 - HC-KAR NC: 2025:KHC:37779 CRL.P No. 12469 of 2025 to perform her marriage with some other boy, he threatened that he will come to the choultry and show her private pictures and messages. It is further alleged that his mother and aunt telephoned and abused her in filthy language and refused to perform her marriage with the petitioner, on the ground that she belong to a different caste. 4. The complainant/victim is present before the Court. She submits that she has no objection to grant bail to the petitioner. She submitted that the petitioner’s parents have agreed to perform her marriage with the petitioner. 5. Learned High Court Government Pleader contended that in view of the allegations made in the complaint, there is a prima facie case against the petitioner and therefore, he is not entitled for bail. 6. The allegation against the petitioner is that, he has committed sexual intercourse with the victim on - 4 - HC-KAR NC: 2025:KHC:37779 CRL.P No. 12469 of 2025 several occasions under the false promise of marriage. Admittedly the victim is a major aged about 34 years. As per complaint averments both are well acquainted with each other since June 2023. Against accused Nos.2 to 4 it is alleged that they abused the victim in filthy language and refused to perform her marriage with the petitioner stating that she belong to different caste etc. 7. In the complaint, it is not alleged that the petitioner has refused to marry the complainant. The ingredients of the offences alleged have to be established in due course. Petitioner has been arrested and he is in custody since 30.07.2025. 8. Learned High Court Government Pleader submitted that the chargesheet has been filed. Hence, imposing suitable conditions, petitioner can be admitted to bail. Accordingly, the following: - 5 - HC-KAR NC: 2025:KHC:37779 CRL.P No. 12469 of 2025 ORDER i. Petition is allowed. ii. Petitioner/accused No.1 in Crime No.119/2025 of Tumkuru Women Police Station, shall be enlarged on bail, subject to following conditions: 1. He shall execute a bond in a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for the likesum to the satisfaction of the jurisdictional Court. 2. He shall furnish proof of his residential address and shall inform the Court, if there is change in the address. 3. He shall not directly or indirectly tamper with the prosecution witnesses. 4. He shall not indulge himself in committing any offence. 5.
