JUSTICE ASHOK S.KINAGI ORAL ORDER These writ petitions are filed challenging the communication dated 13.07.2023 vide Annexures A to A11 to W.P.No.24739/2023 and communication dated 22.03.2022 vide Annexure-A in W.P.No.25046/2023 issued by respondent No.2, wherein the request of the petitioners for regularization of the service was rejected. 2. Brief facts, leading rise to the filing of these writ petitions are as follows: The petitioners were appointed in their respective cadres in respondent No.2-Corporation on different dates. The similarly placed petitioners along with others approached this Court by filing the writ petitions in W.P.No.10745-10756 of 2012 and connected matters. This Court, vide order dated 18.07.2012 directed the respondents to consider the case of the petitioners for - 8 - HC-KAR NC: 2025:KHC:40705 WP No. 24739 of 2023 C/W WP No. 25046 of 2023 regularization as and when it becomes inevitable for the Corporation, in such case, preference and priority should be given to the petitioners. Thereafter, the Corporation, out of 30 employees who have approached this Court on earlier occasion, has regularized 17 of them. Out of them, who were left out, 8 have approached this Court by filing W.P.Nos.27019-27020 of 2017 and connected matters. This Court, vide order dated 08.02.2019 disposed off the said writ petitions with the following directions: "In the light of the above, these petitions are disposed of with a direction to the second respondent - Corporation to consider the representation of the petitioners for regularization, in terms of the order dated 18.07.2012 issued by this Court in W.P.Nos.10745-10756/2012 as expeditiously as possible and in any event, within a period of three months from the date of receipt of a certified copy of this order. If the representation given by the petitioners are not available with the respondent - Corporation, the memorandum of these writ petitions may be treated as a representation by the petitioners." - 9 - HC-KAR NC: 2025:KHC:40705 WP No. 24739 of 2023 C/W WP No. 25046 of 2023 Thereafter, the respondents have issued the impugned endorsements dated 13.07.2023 vide Annexures A to A11 against the petitioners in W.P.Nos.24739/2023 and vide Annexure-A in W.P.No.25046/2023. The petitioners, aggrieved by the endorsements vide Annexures A to A11 in W.P.No.24739/2023, and Annexure-A in W.P.No.25046/2023, have filed these writ petitions. 3. Heard the learned counsel for the petitioners, and also the learned counsel for the respondents. 4. Learned counsel for the petitioners submit that similarly placed persons have approached this Court along with other petitioners in W.P.Nos.10745-10756 of 2012 and connected matters, W.P.Nos.27019-27020/2017 and connected matters and also in W.P.No.19964/2023 C/w W.P.No.17682/2025. The Co-ordinate Bench set aside the endorsement issued by the Corporation, and directed the Corporation to reconsider the case of the petitioners for - 10 - HC-KAR NC: 2025:KHC:40705 WP No. 24739 of 2023 C/W WP No. 25046 of 2023 regularization. He submit that these writ petitions may be disposed off in terms of the order passed by this Court in W.P.No.19964/2023 C/w W.P.No.17682/2025 disposed off on 29.08.2025. Hence, on these grounds, he prays to allow these writ petitions. 5. Per contra, the learned counsel for the respondents submit that these writ petitions may be disposed off in terms of the order passed by this Court in W.P.No.19964/2023 C/w W.P.No.17682/2025. Accordingly, prays to dispose off the petitions. 6. Perused the records, and considered the submissions of the learned counsel for the parties. 7. The Co-ordinate Bench considering the proposition of law laid down by the Hon'ble Apex Court in the cases of JAGGO AND UNION OF INDIA AND OTHERS reported in 2024 INSC 1034 and DHARAM SINGH AND OTHERS VS. STATE OF U.P. AND ANOTHER in CIVIL APPEAL - 11 - HC-KAR NC: 2025:KHC:40705 WP No. 24739 of 2023 C/W WP No. 25046 of 2023 NO.8558/2018, has directed the respondent-Corporation to regularize the service of the petitioners. In view of the proposition of law laid down by the Hon'ble Apex Court in the cases of JAGGO and DHARAM SING (Supra), the petitioners are also entitled to the similar benefit. Considering the order passed by this Court in W.P.No.19964/2023 C/w W.P.No.17682/2025, I proceed to pass the following: ORDER i. The writ petitions are allowed. ii. The impugned endorsement vide Annexures A1 to A11 in W.P.No.24739/2023 and Annexure-A in W.P.No.25046/2023 are quashed. iii. The respondents are directed to consider the case of the petitioners for regularization in terms of the order passed by the Hon'ble Apex Court in the cases of JAGGO and DHARAM SINGH (Supra) as expeditiously as - 12 - HC-KAR NC: 2025:KHC:40705 WP No. 24739 of 2023 C/W WP No. 25046 of 2023 possible not later than three months from the date of receipt of a copy of this order.
