The present writ petition has been filed by the petitioners with the following relief(s) : “10.1) This Hon'ble Court may kindly be pleased to call for the entire records pertaining to the case of the petitioner from the possession of the respondents for its kind perusal. 10.2) That, the Hon'ble Court may kindly be pleased to allow this petition and direct the respondent authority to comply the order dated 04.08.2021 which was passed by the respondent no. 3. 10.3) Any other relief or relief(s) which this Hon'ble Court may think proper in view of the facts and circumstances of the case may also kindly be granted.” 2. Learned counsel appearing for the petitioner submits that by way of this petition, the petitioner is not challenging any particular order but seeking direction to the respondent authority to comply order passed by the respondent no. 3 on 04.08.2021 and eviction order which is passed by the respondent no. 3 is not comply till date after the issuance of order as well as memo. Hence, this petition. 3. Learned State counsel opposes the submission made by counsel for the petitioner. 4. I have heard learned counsel for the parties and perused the documents with utmost circumspection. 5. Considering the facts and circumstances of the case and submission made by learned counsel for the parties. Taking into consideration the 3 fact that the relief which has been sought by the petitioner cannot be granted in exercise of writ jurisdiction and the petitioner has no ground to allow this petition and direct the respondent authority to comply the order dated 04.08.2021 (Annexure P-1) which was passed by the respondent no. 3, in view of the considered opinion of this Court, no case is made out for any interference. 6. Accordingly, the petition being devoid of any merit is liable to be and is hereby dismissed. 7. However, petitioner is at liberty to pursue the matter before respondent No.3 – Sub Divisional Officer, Rajnandgaon, District Rajnandgaon (C.G.) and respondent No.4 – Tahsildar Rajnandgaon, District Rajnandgaon (C.G.) and respondents No.3 & 4 shall consider and decide the matter of the petitioner, in accordance with rules, regulations and law. 8.
