1. Through the instant writ petition filed under Article 226/227 of the Constitution of India, a prayer is made for issuance of a mandamus upon respondents no.3 and 4 to pay the amount for the work done by the petitioner. He further seeks a direction upon the respondents to decide the legal notice dated 22.07.2021 (Annexure P-10).

Learned counsel for the petitioner submits that the work was allotted to the petitioner in the year 2012 and the same was completed in the year 2013-14, however, till date the running bill for that year has not been acquired.
3. The submission, as made by learned counsel for the petitioner was opposed by learned counsel for appearing for respondent DHARAM VIR 2025.04.25 17:32 I attest to the accuracy and integrity of this document
CWP-16188-2021 -2- no.4-Municipal Committee, Bhiwan, and submits that the legal notice (supra), served by the petitioner has already been replied to and the claim of the petitioner was not found to be acceptable.
4. He further submits that there is a huge delay in filing the instant petition.
5. Be that as it may, what reflects from a perusal of the instant petition and the reply, that till date respondent no.4 has not decided the claim of the petitioner by passing a speaking order. Therefore, at this stage, the instant petition can be disposed of, by passing a mandamus upon respondent no.4, to decide the claim of the petitioner by passing a speaking order, at the earliest.
6. It goes without saying that the direction issued by this Court could not be construed to be a ground for condonation of delay in favour of the petitioner.
