The petitioner has sought for an order regarding change of land use in respect of the writ petition schedule property from Park Zone to Residential Zone in the BIAAPA Master Plan, 2021. As the same has not been considered by respondent No.2 so far, the present writ petition is filed with the following prayers: "a. To consider the representation presented by the Petitioner in Annexure E, F and G; b. To direct the Respondent No.2 to issue the Change of Land Use with respect to the said 1 Acre and 33 Guntas out of 3 Acres 32 Guntas of the Schedule Property from PARK ZONE to RESIDENTIAL ZONE in the BIAAP MASTER PLAN 2021 as per the circular issued by the Government dated 18.06.2014 in Annexure-D; and c. Grant such other or further relief as this Hon'ble Court deems fit to grant in the circumstances of the case in the interest of justice and equity." 2. Learned counsel appearing for respondent No.2 submits that respondent No.2, on 06.01.2016 itself, had sent a letter to the petitioner and requested him to furnish certain details so that his application can be considered in - 4 - HC-KAR NC: 2025:KHC:35688 WP No. 26592 of 2018 accordance with law. It is submitted that the petitioner has not yet submitted those details and if he were to submit the same, his request will be considered in accordance with law. 3. Learned Senior Counsel Sri Kiran S.Javali appearing for the petitioner submits that the necessary details will be produced to respondent No.2. 4. Hence, the following: ORDER (i) Liberty is granted to the petitioner to produce necessary particulars to respondent No.2 as demanded; (ii) After receipt of the same, respondent No.2 shall consider the application of the petitioner for change of land use in accordance with law within a period of two months thereafter; (iii) The writ petition stands disposed of accordingly.
