2. The petitioner seeks bail in case registered for offence under Sections 395 of the Indian Penal Code and Section 27 of the Arms Act. 3 . As per prosecution case, some unknown miscreants came on motorcycles, who are armed with weapon overtook the vehicle of the informant and looted collected amount of Rs. 1, 95,000/-, mobile and other documents of the informant and they also made fire in the air.
4. Learned counsel for the petitioner submits that Petitioner is not named in the FIR. The name of the petitioner transpired on the basis of confessional statement of other co- accused, which has got no evidentiary value in the eyes of law .
Patna High Court CR. MISC. No.45685 of 2025(2) dt.22-08-2025 2/2 No incriminating/looted articles have been recovered from the conscious possession of this petitioner. Petitioner claims clean antecedent. Petitioner is in custody since 21.03.2025 . Chargesheet has already been submitted. Similarly situated co- accused person has already granted bail by this Court vide
order dated 31.01.2024 in Cr. Misc. No. 76031 of 2023 . 5 . Learned A.P.P. for the State vehemently opposed the bail petition.

Considering the aforesaid facts, period of custody , clean antecedent of this petitioner and circumstances of the case , let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM 1st Supaul in connection with Tribeniganj P.S. Case No. 54 of 2022 .
