JUSTICE NELSON SAILO 10.02.2025 Heard Mr. R Mozumdar, learned counsel for the applicant and Mr. G Pegu, learned CGC for the respondents. By filing this application, the applicant/petitioner prays for a direction to the respondent authorities concerned not to declare the final result of in respect of 1 post of Constable (Driver) out of the remaining 30 posts allotted to the State of Assam in the selection made under the Central Reserved Police Force. The learned counsel for the applicant submits that the wrirt petition filed by the instant applicant was listed on 16.12.2024 along with a number of other similar writ petitions. However, the case of the applicant was adjourned that day by the learned CGC and therefore, the applicant could not seek for an interim order. In respect of the other similar writ petitions, Court was pleased to direct that 1 post be kept vacant for each of the other writ petitions. He, therefore, submits that a similar order may be passed in favor of the applicant by keeping 1 post of Constable/Driver vacant. Mr. G Pegu, learned CGC, on the other hand, submits that it is not a case Page No.# 3/3 where this Court had passed a direction for keeping 1 post vacant in each of the writ petitions. He submits that except for 1 post, Court had directed any appointments made to the posts concerned would be subject to the outcome of the said writ petitions. Having regard to the projection made by the learned counsels for the parties and on perusal of the materials available on record, this Court is also inclined to give a similar direction to the effect that any appointments made against the post of Constable/Driver out of the 30 remaining posts shall be subject to the outcome of the connected writ petition in WP(C) No. 3978/2024.
