The applicant has preferred this First Bail Application under Section 483 of BNSS, 2023 for grant of regular bail, as he has been arrested in connection with Crime No. 08/2025, registered at Police Station Duldula, District- Jashpur (CG) for the offence punishable under Section 103(1), 238(B), 240 of BNS, 2023. The prosecution story in brief, is that, in the intervening night of 06.02.2025 and 07.02.2025 the applicant has killed his brother Oswal Toppo by assaulting his chest and shoulder with the help of club and thereafter cleaned the blood spread in clothes in order to conceal the evidence. It is further alleged that in order to skip himself from the commission of offence, the applicant has given an intimation regarding death of his brother on account of heart attack. 3. It was argued by the learned counsel for the applicant that the applicant has been falsely implicated in this case. The applicant has not killed his real brother and without any basis, the police has registered the offence against the applicant. The applicant is in jail since 10.02.2025 and conclusion of the trial will take some time. Therefore, he prays for grant of bail to the applicant. 4. On the other hand, learned State Counsel opposes the bail application and submits that all the evidences are against the applicant. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts & circumstances of the case, nature & gravity of the offence, material available in the case dairy, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail. Accordingly, the bail application of 3 applicant- Nobel Toppo involved in Crime No. 08/2025 under Section 103(1), 238(B), 240 of BNS, 2023 at Police Station- Abhanpur, District- Raipur, Chhattisgarh, is rejected. 7. However, this Court hopes and trusts that the Trial Court shall make earnest endeavour to conclude the trial expeditiously as soon as possible in accordance with law, if there is no legal impediment. 8.
