This anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicants, who have been apprehending his arrest in connection with Crime No. 162/2025 registered at Police Station – Hasaud District – Sakti (C.G.) for the offence punishable under Sections 111 of the BNS and Section VAIBHAV SINGH Digitally signed by VAIBHAV SINGH Date: 2025.12.11 12:08:11 +0530

The prosecution story in brief is that, the applicants along with other co- accused persons are alleged of transporting 82 alive cattle to slaughter house at Nagpur Maharashtra illegally in a container vehicle for purpose of slaughtering. The applicants humbly submit that they are innocent and have been falsely implicated in the present case

Learned counsel for the applicants submits that the applicants are innocent and has been falsely implicated in this case. It is further submitted that there is no prima-facie evidence against them in the FIR to suggest their involvement. The investigation is ongoing, and the applicants are willing to fully cooperate if released on anticipatory bail, with no requirement for further interrogation. They further submit that similarly placed co-accused have already been granted bail by this Hon’ble Court in MCRC/2168/2025 vide order dated 13.11.2025. The applicants are permanent residents of Chhattisgarh with deep societal roots and, therefore, there is no likelihood of them absconding, tampering with evidence, or influencing witnesses. They have never been of a threatening nature and assure this Hon’ble Court that they shall furnish adequate security and strictly abide by all conditions and directions imposed while granting anticipatory bail, therefore, he prays grant of bail to the applicant. 4. On the other hand, learned State Counsel appearing for the non- applicant/State opposes the bail application. 5. I have heard learned counsel for the parties and perused the materials available on record. 6. Considering the facts and circumstances of the case, the submissions
3 of the learned counsel for the parties, the nature of the dispute, and the material available in the case diary, it is noted that the co-accused, Yogesh Kumar, has already been granted regular bail by this Court in MCRCA No. 1912 of 2025 vide order dated 04.12.2025, therefore, without expressing any opinion on the merits of the case, I am inclined to grant anticipatory bail to the present applicants. 7. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicants – Omprakash Banjare & Mitthulal Banjare on executing a personal bond and one local surety in the like sum to the satisfaction of the arresting Officer, he shall be released on bail on the following conditions:- (a) he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) he shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) he shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial.
(d) the applicant and the surety shall submit a copy of his adhaar card along with a coloured postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court.
