The present Writ Petition is filed for non declaration of the probation of the Petitioner from the date of his joining in the cadre of Assistant Commercial Tax Officer (hereinafter referred to as “A.C.T.O’) as illegal and arbitrary. 2. The probation of the Petitioner was declared under Rule 16 (h) of the Andhra Pradesh State and Subordinate Rules, 1996, with effect from 29.01.2008 by the Deputy Commissioner (CT), Guntur Division, Guntur, though the Petitioner had joined in the cadre of Assistant Commercial Tax Officer on
01.03.2005. 3. Subsequently, the State Government, in exercise of the power under Rule 31 of the A.P. State and Subordinate Rules, 1996, issued G.O.Rt.No.5, Revenue (Commercial Taxes-I) Department, dated 01.01.2019, wherein it is mentioned that cases of 12 Officers including the Petitioner was considered for declaration of probation from the date of joining as Assistant Commercial Tax Officers, but in later part of the G.O.Rt.No.5,

the probation of 11 other Officers was declared and the Petitioner was excluded from such relief without assigning any reason. 4. Though the Petitioner has been given a representation for declaration of his probation on par with the persons referred to in G.O.Rt.No. 5, dated 01.01.2019 i.e., from the date of joining as Assistant Commercial Tax Officer (ACTO), there is no response from the Respondents. Hence, the present Writ Petition. 5. Sri S. Raju, learned Assistant Government Pleader, submits that if a representation is given by the Petitioner, the same would be considered taking note of the factual circumstances. 6. Heard the respective counsel. 7. Considering the submissions made, the Writ Petition is disposed of with the following directions: i) The Petitioner is directed to give a comprehensive representation to the Respondent No.1 for considering his case at par with the persons referred to in G.O.Rt.No.5, Revenue (Commercial Taxes-I) Department, dated 01.01.2019.

ii) On receipt of the representation, the Respondent No.1 shall examine the same and pass appropriate orders taking note of G.O.Rt.No.5, Revenue (Commercial Taxes-I) Department, dated 01.01.2019, within a period of two months thereafter. iii) There shall be no order as to costs.
