B S REDDY 3 The Court made the following: ORDER: The instant Writ Petition is filed by the Petitioners seeking indulgence of this Court under Article 226 of the Constitution of India for the following relief: “ ... to issue a Writ, Order or Direction more particularly a Writ of Mandamus declaring the inaction of the Respondents 2 to 5 in registering a criminal case against Respondents No.6 and providing protection to the Petitioner as illegal, arbitrary, and violative of Articles 14 and 21 of the Constitution of India) Direct the Respondents 2 to 5 to provide police protection to the Petitioner and his agricultural land in Survey No.165 to an extent of Ac.2.10 Cents, Ernapadu Village, Bandi Atmakur Mandal, Nandyal District from Respondent No.6. e) Direct the 4th Respondent to forthwith register an FIR on the complaint dated 27.10.2025 lodged by the Petitioner and investigate into the cognizable offences committed by 6th Respondent and others. f) Pass ....” Heard Sri T.Ashok Srivastava, learned counsel for the Petitioners, learned counsel for respondent No.6 and learned Assistant Government Pleader for Home. Perused the material on record. Learned counsel for the Petitioners would submit that the subject property is the ancestral property, and the said property was inherited to their father from their grand-father and their father name was also mutated in the revenue records. Further, respondent No.6 is the cousin to the Petitioners’ father. Due to hike in market value, respondent No.6 demanded the subject property to lower rate. Petitioners’ father filed a suit in OS No.581 of 2017 on the file of the Court of Principal Junior Civil Judge, Nandyal seeking permanent injunction against respondent No.6 and his men. In that suit in IA No.1514 of 2017 the Trial Court vide Order dated 26.10.2018 granted temporary injunction in favour of the Petitioners. Further respondent NO.6 along with two others 4 trespassed into the subject property using tractor and drove it through the paddy seed crop and damaged the fencing, threatened and insulted the petitioner No.1’s wife. A complaint in Crime No.88 of 2024 was lodged against the respondent No.6 which is the subject matter in CC No.204 of 2025 on the file of the Court of Judicial Magistrate of First Class, Nandyal. Petitioners sought police protection to the subject property which the police did not provide so far. On the other hand, learned counsel for respondent No.6 would submit that there is no crop which would require emergent need for police protection. Learned Assistant Government Pleader for Home would submit that the Court may pass appropriate orders by disposing of this Writ Petition. Admittedly, there are disputed facts involved in this matter. Petitioners sought for police protection. In that view, without causing any prejudice to the rights and contentions of both the parties, this Writ Petition is disposed of granting liberty to the Petitioners to work out the remedy before the Trial Court where the suit is pending, in case of any requirement of police protection.
