4. The instant petition has been preferred by the applicants under Section 528 of BNSS, 2023 challenging the proceedings of Criminal Case No. 119 of 2023 (State Vs. Kamlesh Bora and others) arising out of FIR dated 30.12.2022 bearing FIR No. 01/2023, Revenue Area Jaina, Patti Joshikhola, Betalghat, District – Nainital, pending in the court of Civil Judge (JD) / Judicial Magistrate, Ranikhet, District – Almora.

Now, compounding application has been moved with the affidavit of applicants and respondent no. 2 wherein it is contended that since the dispute was matrimonial and the parties have now decided to get divorce by way of mutual consent and it is agreed between the parties that towards permanent alimony, husband shall pay Rs. 12,20,000/- and in terms of the compromise, divorce petition has already been filed by way of mutual consent wherein on first motion, Rs. 5,00,000/- has been paid by the husband to wife
and remaining Rs. 7,20,000/- will be paid by husband on completion of second motion.
6. Both the parties are present in the court and they are duly identified by their respective counsel through their Adhar card.
7. Both the parties submit that since they have settled their dispute amicably and they do not want to pursue this matter.
8. Learned State Counsel submits that since the dispute appears to be matrimonial in nature and now the parties have decided to settle their dispute to get divorce by way of mutual consent, therefore, there is no useful purpose to proceed with the trial.
9. In such view of the matter, present petition filed under Section 528 BNSS, 2023 as well as compounding application no. 02 of 2026 are allowed. Entire proceedings of Criminal Case No. 119 of 2023 (State Vs. Kamlesh Bora and others) pending in the court of Civil Judge (JD) / Judicial Magistrate, Ranikhet, District – Almora are hereby quashed.
