1 Serial No.18 Regular List HIGH COURT OF MEGHALAYA AT SHILLONG MC[WP(C)] No. 50 of 2024 in WP(C). No. 400 of 2023 Date of Decision: 05.08.2025 1. Shri. Mr. S.Marpan, Adv. i) Whether approved for reporting in Yes/No Law journals etc: 2025:MLHC:689 2 ii) Whether approved for publication Yes/No in press: JUDGMENT AND ORDER (ORAL) 1. In the course of the proceedings of WP(C). No. 400 of 2023, one Shri. Kerlang Tariang has filed the instant misc. application for impleadment as a necessary party, which has been objected to by the petitioner. 2. A perusal of the application for impleadment reflects that the applicant has sought to bring on record the fact that the matter relating to the control, management and administration of Raid Amwi is under dispute and is being adjudicated before the Court of competent jurisdiction at Amlarem in a Title Suit being T.S. No. 2 of 2021. 3. This fact has been noted by this Court and the same is also not disputed by the learned counsel for the writ petitioners, who further submits that an earlier suit with regard to the subject matter had been filed before the Sub-Ordinate District Council Court, which has since been dismissed for want of jurisdiction. 4. As the main writ petition has since been disposed of, the instant misc. application for impleadment also does not warrant any further orders, except 2025:MLHC:689 3 that whatever dispute that remains, particularly regarding the management and administration of Raid Amwi, be adjudicated before the said Court where the Title Suit is pending. 5. Accordingly, the misc. case also stands disposed of. Judge 2025:MLHC:689 Digitally signed by SAMANTHA ANNA LIYA RYNJAH Date: 2025.08.05 07:10:06 IST
