JUSTICE S.R.KRISHNA KUMAR ORAL ORDER In this petition, petitioner seeks the following relief: “To quash the proceedings in Crime No.1/2025 of respondent Lokayukta Police for the offence punishable U/s. 7(a) of P.C. Act 1988 (Amendment Act, 2018), pending on the file 1st Addl. District and Sessions Judge, Shivamogga, in the interest of justice.” 2. Heard learned counsel for the petitioner and learned counsel for respondent No.1 and perused the material on record. 3. During pendency of this petition, on 19.06.2025, this Court passed the following order: “Learned counsel for the respondent – Lokayukta submits that the final report would be kept ready within a period of two weeks from today. His submission is placed on record. List this matter on 03.07.2025.” 4. Subsequently, respondent – Lokayuktha have prepared a final report and learned counsel would submit that the same would be filed at the earliest before the Special Court after obtaining requisite sanction in this regard. - 3 - HC-KAR NC: 2025:KHC:24139 CRL.P No. 4062 of 2025 5. Learned counsel for the petitioner submits that the present petition may be disposed of reserving liberty in favour of petitioner to challenge the final report including filing of fresh petition and approaching this Court, in accordance with law. It is also submitted that till submission of said final report, concerned respondent may be directed not to address any communication to the concerned department about submission of final report. 6. The said submission is placed on record. 7. In view of the aforesaid facts and circumstances, I deem it just and appropriate to dispose of this petition by issuing certain directions. 8. In the result, I pass the following: ORDER (i) The petition is disposed of. (ii) Respondent – Lokayuktha are permitted to submit the final report to the Special Court after obtaining requisite sanction, in accordance with law. - 4 - HC-KAR NC: 2025:KHC:24139 CRL.P No. 4062 of 2025 (iii) Respondent are directed to submit the final report within a period of one month from the date of obtaining sanction. (iv) Liberty is reserved in favour of the petitioner to file fresh petition after submission of final report. (v) Respondent – Lokayuktha are directed not to address any communication to the employer of the petitioner regarding submission of final report.
