Learned counsel for State submits that order Annexure P-7 which is subject matter of challenge in this writ petition is appealable under Section 44 of the Chhattisgarh Land Revenue Code, 1959. 2. After arguing for sometime, learned counsel for petitioner submits that he may be permitted to withdraw the present writ petition with liberty to avail remedy of appeal under the Code of 1959. He further submits that according to the policy formulated by the State Government the paddy which is sown in the agricultural land (disputed land) is to be purchased by the State Government and if name of petitioner is not mutated in the revenue records, he would not be able to sell the paddy in accordance with policy formulated by State Government and will suffer huge loss. He therefore submits that direction be issued to Sub Divisional Officer (Revenue) to consider the application along with the application of Interim Relief at the earliest. 3. In view of submission made by counsel for both the respective parties, present with petition is dismissed as withdrawn, however in view of the difficulty shown by the petitioner in selling paddy, Sub Divisional Officer (Appellate Authority) is directed to consider the appeal to be filed by petitioner expeditiously in accordance with law keeping in mind date fixed by State Government for registration of agriculturist in respective society and date fixed for purchase of society. 4. Office is directed to return back the certified copy enclosed with this writ petition to the petitioner after retaining the photocopies of the same. C.C.
