K SRINIVAS 3 HBKM,J W.P.No.13420 of 2022 The Court made the following Order: Heard the learned counsel for the petitioners, the learned Assistant Government Pleader for the respondent Nos.1 to 4 and the learned counsel appearing for the respondent Nos.5 to 8. 2. This writ petition was filed against the order of the 2nd respondent dated -02-2022 vide D.Dis.No.5089/2020/D4 dismissing the revision before it confirming the orders passed by the Revenue Divisional Officer, Ananthapuramu in D.Dis.No.1198/2019 (D2) dated 23.10.2020. 3. The petitioners herein are the revision petitioners before the 2nd respondent aggrieved by the orders passed by the 3rd respondent dated 23.10.2020. The respondent Nos.5 to 8 herein are the respondents therein before the 2nd respondent. 4. When the appeal was preferred by the petitioners herein before the 3rd respondent seeking cancellation of pattadar passbooks issued in Sy.No.46-1 to an extent of Ac.13.80 cents and in Sy.No.46-3 to an extent of Ac.0.10 cents vide Khata No.65 of Obulapuramu Village, Garladinne Mandal, upon consideration of the matter on merits, the appeal was dismissed. Accordingly, the 4th respondent was directed to delete the Sy.No.46-1 to an extent of Ac.13.80 cents and Sy.No.46-3 to an extent of Ac.0.10 cents of Obulapuramu Village, Garladinne Mandal from the web land dispute register by specifically indicating that an appeal would lie against the said order before the Joint 4 HBKM,J W.P.No.13420 of 2022 Collector, Ananthapuramu within 30 days from the date of receipt of the said order. 5. Aggrieved by the orders of the 3rd respondent dated 23.10.2020, the petitioners filed the above said revision before the 2nd respondent and upon consideration of the matter in detail, the 2nd respondent dismissed the said revision in D.Dis.No.5089/2020/D4 dated -02-2022. 6. The learned counsel for the petitioners submits that the petitioners along with others initiated the action against the unofficial respondents in O.S.No.1014 of 2021 on the file of Junior Civil Judge, Ananthapuramu with respect to the same subject land and the same is pending on its file. 7. On the other hand, the learned counsel appearing for the respondent Nos.5 to 8 submits that the petitioners ought not to have preferred the appeal before the 3rd respondent as they have not assailed any of the proceedings of the 4th respondent. However, the 3rd respondent rightly dismissed the said appeal of the petitioners, which was confirmed by the 2nd respondent. 8. The learned Assistant Government Pleader also makes the similar submissions. 9. In view of the above said facts and circumstances, as the suit is pending before the competent trial Court, both the parties, including the petitioners and the respondent Nos.5 to 8 are directed to proceed with the same in accordance with law and subject to outcome of the same, the parties 5 HBKM,J W.P.No.13420 of 2022 concerned can approach the revenue authorities for consequential modifications, if any, warranted as per law for mutation of their names in the revenue records with respect to the subject land. 10. Accordingly, this Writ Petition is disposed of. Interim order if any deemed to have been vacated. There shall be no order as to costs.
