1. Heard learned counsel for the parties. 2. The present writ petition has been filed for the following reliefs:-
i. For grant of an appropriate writ(s)/order(s)/direction(s) for quashing the order dated 6.6.2023 (Annexure-8) passed by the respondent no.2 in Appeal No. 87 of 2020-21 affirming the order dated 21.5.2020 (Annexure-3) under Memo No. 606 passed by the respondent no. 3 whereby and where under the Licence No. 41 of 2009 granted to the petitioners has been cancelled. ii. For direction to the concerned respondent to restore the licence No. 41 of 2009. 3. It appears that the petitioners are the group of females and they have been allotted a PDS shop through licence bearing Licence No.41/2009. The allegation has been made that during COVID-19 pandemic certain discrepancy has been committed by the petitioners in distribution of the PDS Goods to the beneficiaries and on that basis, a proceeding has been initiated and after following the process, their licence has been cancelled by the order of District Supply Officer, Bokaro contained in Memo No.606 dated 21.05.2020. 4. The said order has been appealed but the appellate authority has upheld the order without assigning any reason and as such a writ petition has been preferred before this Court being W.P.(C) No.4277 of 2020. The said writ petition has been disposed of vide order dated 07.06.2022 quashing the appellate order and

the matter has been remitted to the Deputy Commissioner, Bokaro for passing afresh order after considering the defense raised by the petitioners. 5. Upon such remand, the order dated 06.06.2023 has been passed by the Deputy Commissioner, Bokaro in PDS Licence Cancellation Appeal Case No.87/2020-21 which has been impugned in the present writ petition. 6. From perusal of the impugned order, it appears that it was COVID-19 pandemic and certain precaution has been taken to avoid the infection. 7. Prima facie, it appears to be a plausible explanation. Furthermore, the licence has been operated for more than 11 years by a group of women, for whose benefit the scheme has been made. 8.
In view of above discussion, the impugned order dated 06.06.2023 passed by the Deputy Commissioner, Bokaro in PDS Licence Cancellation Appeal Case No.87/2020-21 is, hereby, quashed and set aside. 9. The respondent authorities are directed to proceed further so far as the PDS licence No.41 of 2009 is concerned and the beneficiaries should be reattached with the shop of the present petitioners within a month from the date of receipt/production of a copy of this order. 10. With above observation and direction, the present writ petition stands
