1. In the instant contempt petition, the petitioners have alleged non- compliance of order and judgment dated 18.03.2015 passed in SWP No. 1397/2013 in terms whereof, it came to be provided that the dependents of deceased Inspector late Shri Ram Parkash Singh are entitled to all Monetary benefits including pension/ family pension at the rate provided under the applicable service rules taking it as a case of deceased having died in harness and not retired upon superannuation. While, observing further that the benefits of compassionate appointment in accordance with rules shall also be available to the said dependents directing further that the respondents are directed to provide all such benefits to the petitioner/ dependants of the deceased in accordance with the applicable service rules, however, declined the relief of grant of back wages.

Statement of facts has been filed by the respondents/ contemnors, wherein it is being, inter alia, stated that the dependants of the deceased stand extended all benefits in tune with the judgment and order dated 18.03.2015, except the compassionate appointment for which the petitioner’s daughter was asked to fill up the form for the next compassionate appointment process, in that in the earlier process, the said daughter of the deceased failed to qualify for appointment against the post of Head Constable/ Min recruitment and that the said daughter of the deceased would be considered for the post of ASI/ Steno and Constable/ GD (Female).

3. In view of the aforesaid statement of facts filed by the respondents, seemingly, the respondents/ contemnors have complied the judgment and
order.
4. Since none has been appearing for the petitioners for the last more than 05 consecutive dates of hearings, the contempt notice issued to the respondents is recalled and the proceedings in the instant are closed, however, with the liberty to the petitioner to seek revival of the instant petition within four weeks time from today in case the cause survives.
