ORDER ON BOARD 16 /12/2025
1. The petitioner has filed this writ petition seeking following reliefs:-
“10.1 That, the Hon’ble Court may kindly be pleased to call for entire records pertaining to the case of petitioner. 10.2 That, if the Hon’ble Court may kindly be pleased to issue a writ in nature of mandamus whereby, to direct the Respondent No. 2/Collector Surguja, District – Surguja to decide the pending representation made by the petitioner within a stipulated time with regard to restoration of possession of the nazul/government land of Block No. 1, Plot No. 6 admeasuring 200 square meteres situated at Mohalla Navapara, Ambikapur a government patta/lease of which was issued in favour of the petitioner by the Respondent Collector Surguja Ambikapur or in lieu of restoration another
2 government land be provide to the petitioner in the interest of justice. 10.3 That, any other relief or reliefs may also be granted to the petitioner which this Hon’ble Court deems fit and proper in the facts and circumstances of the case.”
2. Learned counsel for the petitioner submits that he is not pressing this writ petition on merits and is only seeking a direction to the Respondent No. 2/Collector to take decision on the pending representation at the earliest.
3. On the other hand, learned counsel for the Respondents/State submits that as the petitioner is not pressing this writ petition on merits and is only seeking a direction to consider and decide his representation, he is having no objection to the limited prayer.
4. I have heard learned counsel for the parties and also perused the documents placed on record.
5. On due consideration of the submission of counsel for the parties, nature of grievance raised by the petitioner, I find it appropriate to dispose of this writ petition directing the Respondent No. 2/Collector to consider and take decision on the representation submitted by the petitioner expeditiously, within a further period of 04 weeks from the date of receipt of the order.
6. With the aforesaid observation and directions, this writ petition stands
