IA NO: 1 OF 2021 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased be pleased to stay the investigation and all the further proceedings the petitioner with respect to FIR No. 101 of 2018 of Pileru Police Station, Chittoor district wherein the petitioner is arraigned as A-3 and pass such order or orders as this Hon'ble Court may deem fit and proper in the interest of justice. VUTUPALLI RAJANNA The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “....pleased to issue an order or other direction especially in the nature of writ of mandamus or any other appropriate writ order declaring that all proceedings taken up and continued in pursuance of the FIR No.101 of 2018 including investigation relating to me are unconstitutional arbitrary capricious and in violation of the Article 14 19 and 21 of the Constitution of India and pass such other order/orders as are deemed fit and proper in the circumstances of the case in the interest of justice” 2. Heard Ms.Charishma Atla, learned counsel representing Sri V.Seetharama Avadhani, learned counsel for the petitioner, Sri Md.Farooq, learned Assistant Government Pleader for Home and learned Special Public Prosecutor for C.I.D. 3. Learned Special Public Prosecutor for C.I.D. brought to the notice of this Court that in the light of the Judgment passed by Hon’ble Supreme Court in Neeta Singh and others vs. State of Uttar Pradesh and others1 and Pradnya Pranjal Kulkarni vs. State of Maharashtra and another2, this Writ Petition is not maintainable after the Court has taken cognizance of the offence. 4. Learned Special Public Prosecutor would further submit that this Writ Petition is filed when the matter is at crime stage. During the pendency of this Writ Petition, investigation is completed, charge sheet is filed and Court has taken cognizance of the offences in Spl.S.C.No.55 of 2022 on the file of learned Special Judge, Chittoor. 1 2024 SCC OnLine 5761 2 2025 SCC OnLine 1948 5. In that view, the Writ Petition is disposed of. However, the petitioner is at liberty to work out their remedies before appropriate forum, in accordance with law.
