The applicant has preferred this First Bail Application under Section 483 of BNSS, 2023 for grant of regular bail, as he has 2 been arrested in connection with Crime No. 150/2025, registered at Police Station Hirri, District- Bilaspur (CG) for the offence punishable under Sections 191(2), 191(3), 103(1) of BNS, 2023. 2. The prosecution story in brief, is that, the complainant, Smt. Nandini Dhruv, lodged a verbal report at the police station Hirri, stating that her father-in-law, Feku Ram along with his two brothers Lekh Ram and Narad Singh Dhruv were joint holders of ancestral agricultural land. Although the land was being cultivated by all three brothers, only Feku Ram and Lekh Ram’s names were recorded in the land lease documents. Narad Singh Dhruv’s name was not entered in the revenue records. It is alleged that Feku Ram had consistently advocated for a partition of the land including a share for his younger brother Narad Singh. However, Lekh Ram was opposed to this and made threats that if he was forced to partition the land, he would kill the entire family. On 8.06.2025 at around 8:30 PM, while Feku Ram was sitting outside his house, and the complainant was washing utensils, it is alleged that the accused persons namely Lekh Ram (uncle-in-law), Maheshiya Bai (aunt-in-law), Milap, Ishwar and Shubham arrived at the scene. Milap and Ishwar allegedly assaulted Feku Ram with wooden sticks and subsequently, Shubham allegedly struck him with a sabbal near his private parts, causing severe bleeding. When the complainant, her husband and her mother-in-law attempted to intervene, they were allegedly restrained. 3 3. It was argued by the learned counsel for the applicant that the applicant has been falsely implicated in this case. There is no direct evidence against the present applicant to connect him with the crime in question. The facts indicate that there was a sudden quarrel between the parties, therefore it was not pre-planned. One co-accused has been granted bail by this Hon’ble Court in MCRC No. 8114 of 2025. The applicant is in jail since 09.06.2025 and conclusion of the trial will take some time. Therefore, he prays for grant of bail to the applicant. 4. On the other hand, learned State Counsel opposes the bail application and submits that all the evidences are against the applicant. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts & circumstances of the case, nature & gravity of the offence, material available in the case dairy, the statement of the eye-wintess Ms. Nandini, P.M. report reveals that there are injuries over his private parts, this Court is of the opinion that it is a case of broad day light murder and it is not a fit case to enlarge the applicant on regular bail. Accordingly, the bail application of applicant- Lekhuram Dhruv involved in Crime No. 150/2025 under Sections 191(2), 191(3) and 103(1) of BNS, 2023 at Police Station- Hirri, District- Bilaspur, Chhattisgarh, is rejected. 4 7. However, this Court hopes and trusts that the Trial Court shall make earnest endeavour to conclude the trial expeditiously as soon as possible in accordance with law, if there is no legal impediment.
