Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the inaction of respondents 3rd and 4th in interfering with civil disputes without there being any right and title over the subject land an extent of Ac. 0.30 Ankanams in the Sy No 179/1 of SV Palem Village, Bogolu Mandal, SPSR Nellore District as illegal, arbitrary and violative of Articles 14 and 21 of the Constitution of India and consequently direct the respondents to give police protection to petitioner in respect of above said property and pass IA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the 3rd and 4th respondents not to interfere with civil disputes which is subject property an extent of Ac. 0.30 Ankanams in the Sy No 179/1 of SV Palem Village, Bogolu Mandal, SPSR Nellore District, pending disposal of the writ petition, and pass Counsel for the Petitioner:

This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“…to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the inaction of respondents 3rd and 4th in interfering with civil disputes without there being any right and title over the subject land an extent of Ac. 0.30 Ankanams in the Sy.No.179/1 of SV Palem Village, Bogolu Mandal, SPSR Nellore District as illegal, arbitrary and violative of Articles 14 and 21 of the Constitution of India and consequently direct the respondents to give police protection to petitioner in respect of above said property and pass..…”
2. Heard Sri M.K.Raj Kumar, learned Counsel for the Petitioner and Sri V.Farook, learned Assistant Government Pleader for Home for the Official Respondents. 3. Learned Assistant Government Pleader for Home, on written instructions, would submit that a case has been registered against the sons of the Petitioner and 2 others, basing on the complaint made by the 5th Respondent in Cr.No.102 of 2025 U/sec. 329(3), 115(2), 351(2) r/w 3(5) of BNS. He would further submit that regarding the said crime, the Petitioner was called to the Police Station and no crime has been registered against the Petitioner. The Police are not interfering in the civil disputes between the parties. 4
4. Recording the same, this Writ Petition is disposed of. However, the Police are directed not to interfere in the civil disputes between the parties except under due process of law. There shall be no order as to costs.
